Tte plaintiff applied for a writ of certiorari to require the defendant, as judge of the district court of Box Elder County, Utah, to certify to this court a transcript of the proceedings had in the estate of one Joseph T. Anderson, deceased. A writ was duly issued requiring defendant to certify 'said proceedings, which has been done; From the application it is made- to appear that the plaintiff is the mother of one Maggie Rlohwer, who, on the 22d day of March, 1898, died intestate leaving surviving her said Joseph T.
