In February, 1923, the ap-pellee Mrs. W. D. Map, joined by hér husband, filed this suit in the district court of Cass county against the appellant. The purpose of the suit was to recover the sum of $439.34, which the plaintiff alleges she had on deposit in that bank and which the latter refused to pay over to her upon demand. Appellant answered alleging, in substance, that it was the owner and holder of a note for $1,757.39 signed by W. D.
