MEMORANDUM AND ORDER

WEXLER, District Judge.

Petitioner pro se Michael Gonzalez (“petitioner” or “Gonzalez”) seeks a writ of habeas corpus pursuant to 28 U.S.C. § 2254. For the reasons set forth below, the petition is denied.

BACKGROUND

I. State Proceedings

In 1986, petitioner was convicted by a jury in the Supreme Court, Suffolk County, of robbery in the first degree and is now serving an indeterminate sentence of eight to sixteen years.
