DECISION REGARDING MOTIONS FOR JUDGMENT ON THE PLEADINGS

Plaintiff Betty Jettmar (“Jettmar”) has sued for a determination that her lien on certain assets of The New 5510, Inc., (“the Corporation”) takes priority over the later-filed lien of Madison National Bank (“Madison”). The Court determines that Jett-mar’s lien was unperfected for failure to list the Corporation as debtor on Jettmar’s financing statement and must be avoided under 11 U.S.C. § 544(a)(1).
