Appeal from an order of the Surrogate’s Court of Saratoga County (Brown, S.), entered May 8, 1981, which denied petitioner’s motion to require respondent to file an answer. Decedent, a resident of Saratoga County, died intestate on February 4, 1980. Thereafter, pursuant to SCPA 2103, petitioner Robert Sudduth, as administrator of the estate of Ida Coon, commenced a proceeding to discover certain property allegedly withheld from the estate by respondent Helen V.
