M. F. Boyd sued the Texas & Pacific Railway Company for damages resulting from personal injuries sustained by him, and from a judgment in his favor the defendant has appealed.
Plaintiff was marshal of the town of Gordon, and on the night of his injury he, together with A. M. Barrett, the mayor of the town, went to defendant’s station in the town of Gordon, intending to go to the town of Santo on defendant’s train to search for persons suspected of burglarizing a house in Gordon a short time prior thereto.
