This is an appeal by H. Cahen, one of the defendants, from an order denying his motion to vacate a judgment against himself. The motion was made under section 473 of the Code of Civil Procedure, and reliance was had principally upon the ground of the mistake of his attorney.

The action was commenced in 1894 against the defendants, as copartners, under the firm name of A. Cahen" & Son, for the conversion of seventeen bales of wool.
