RONEY, Circuit Judge:

Defendant David Jefferies Thompson was charged with knowing possession of 50 pounds of marijuana with intent to distribute, in violation of 21 U.S.C.A. § 841(a)(1). A motion to suppress the marijuana as the product of an illegal search was denied. By stipulation, the evidence on the motion to suppress was considered by the Court on the merits of the case. Defendant was found guilty. On appeal, Thompson contends that the motion to suppress should have been granted for one of three alternative reasons: first, the designation by the Bureau of Customs of a border patrol…
