This is a suit upon a policy of fire insurance on a Plymouth automobile brought by Charles D. Williams for the use of the Elliott Motor Company. The case was heard by the court and a jury and resulted in a judgment for the plaintiff beloyr on June 19, 1940, for the sum of $440 and costs. The defendant Insurance Com pany appealed in error to this court and has assigned four errors to the effect that there was no evidence to support the verdict, that the plaintiff failed to comply with the terms of the policy of insurance, that there had been a change in ownership of the automobile before the…
