This cause reached-this court by a certification, under the Constitution, made by the St. Louis Court of Appeals. Two opinions were filed in that court. The majority opinion affirmed the judgment of the circuit court. The minority opinion held that the judgment should be reversed, and the writer *341of the minority opinion ashed for the certification of the cause here on the ground that the majority opinion conflicted with Priest v.
