McKAY, Justice.

Peter Franklin Rosetta, appellee, brought this suit for divorce from Janice Carolyn Rosetta, appellant, alleging they had a common law marriage as of July 1, 1970, and asking that he be granted a divorce and be appointed managing conservator of their minor child, Theresa Angelique Rosetta (hereinafter called Angie). The trial court heard the case without a jury, and on July 17, 1974, rendered judgment that the parties had a common law marriage, that ap-pellee be granted a divorce, and that appellant be appointed managing conservator of the minor child with appellee granted…
