BERRY, Judge. —
Appellant was convicted in the district court of Milam County for the offense of murder and his punishment assessed at confinement in the penitentiary for a term of five years.
Appellant and deceased were first cousins. Appellant is a married man about thirty-three (33) years of age and deceased was a single man about the age of twenty-three years. The killing grew out of what the appellant claimed was alleged improper relations between deceased and the wife of appellant.
