The facts material to a ruling on the demurrer lodged against the bill of complaint in this case are, as shown by the record, as follows :
By an ordinance of defendant city, duly passed and published on the 1st day of February, 1907, complainant was granted the right and authority to construct and operate along and over certain streets and avenues of defendant city a standard-gauge electric interurban railway for a period of 20 years, under certain terms, conditions, and , restrictions set forth in said ordinance.
