John D. Lemons instituted this suit against George E. Simmons,.W. T. Nichols, Jr,, and W. I. Boyd, alleging, in substance, that he had conveyed a certain tract of land situated in Jack county, Tex., to said Simmons, for which he received $100 in cash and $800 in vendor’s lien notes, given for another and different tract of land described in the petition.
