HUDSON, District Judge.
This matter is before the Court on Plaintiffs Motion for Preliminary Injunction and Defendants’ Motion to Dismiss or for Summary Judgment. Both counsel have submitted extensive memoranda of law supporting their respective positions. The Court heard oral argument on April 26, 2005.
