*440There are two appeals on this record by the Citizens Trust & Guaranty Co., one being prosecuted from a judgment in favor of Peebles Paving Brick Co., and the other from a judgment in favor of J. B. Speed & Co. There is also a cross-appeal by the Peebles Co. against the Citizens Trust & Guaranty Co.
