OPINION OF THE COURT

VAN DUSEN, Circuit Judge.

This appeal challenges the district court order filed August 5, 1974, which dismissed plaintiff’s habeas corpus petition. We disagree with the lower court’s holding that no cause of action is *832presented by this claim arising under the Interstate Agreement On Detainers 1 and therefore vacate and remand for further proceedings.
