Appeal by the defendant from a judgment of the Supreme Court, Kings County (Guzman, J.), rendered July 8, 2011, convicting him of endangering the welfare of a child (two counts), upon a jury verdict, and imposing sentence.
Ordered that the judgment is reversed, on the law, on the facts, and in the exercise of discretion, the conviction of endangering the welfare of a child, as charged in count five of the indictment, and the sentence imposed thereon, are vacated, that count of the indictment is dismissed, and the matter is remitted to the Supreme Court, Kings County, for further proceedings on…
