delivered the opinion of the Court:
This was an appeal from a justice of the peace of Cook county to the Superior Court of that county. On the 16th day of January, 1872. plaintiff moved to dismiss the appeal, for the reason that an affidavit of merits had not been filed by the defendant. Thereupon, the court dismissed the appeal, and awarded a procedendo to the justice of the peace, and awarded execution for costs against defendant.
