Introduction
The principal question posed by the within mandamus proceeding is whether or not a hospital waives the immunity from discoveiy provided in Evidence Code section 1157 (hereinafter section 1157) by filing a transcript of its staff committee hearing in an unrelated administrative mandamus proceeding in which a physician, who is also a defendant in a separate medical malpractice suit, contests the hospital’s decision suspending his staff privileges.
