This action was originally brought in the Court of Common Pleas of Wyandotte County by the defendant in error, against the plaintiff in error, to recover damages alleged to have been sustained by the plaintiff below by being run over by the wagon of the defendant. The case was tried to the court and a jury, and the jury returned a general verdict for the plaintiff for one thousand dollars, and also answered special questions of fact submitted to them on behalf of the defendant.
