KRUEGER, Judge.

The appellant was tried and convicted of the oifense of murder and his punishment was assessed at confinement in the penitentiary for a term of 25 years.

The record shows that appellant and deceased attended a dance at the home of H. A. Thomas on the night of December 25, 1934, where appellant and one Alvin Thomas became involved in a controversy over the payment for the privilege of dancing a certain set. Soon thereafter the deceased approached appellant and requested that he cease cursing in the presence of the ladies, which appellant denied having done, and this brought about…
