Pending before the Court is plaintiffs’ Motion for an Injunction enjoining the defendants Drug Enforcement Agency (“DEA” or “Agency”) from promoting DEA Special Agents to the Senior Executive Service (“SES”) unless the Agent has applied and been rated and ranked as a qualified applicant pursuant to the SES promotion procedures stipulated to by the parties and approved by this Court on March 12, 2002.
