Judgment went in the court below for plaintiffs, and defendant appeals from the judgment and from an order denying his motion for a new trial.
The action was to quiet title to certain described land. The answer merely denies the ownership of plaintiffs and avers ownership in defendant. It is admitted that on the second day of January, 1897, -the defendant was the owner in fee of the land, and that at said date and for two or three years previous thereto the plaintiffs held a mortgage on the land executed by defendant for something over five thousand dollars.
