Appeal from a judgment of the County Court of Delaware County (Becker, J.), rendered January 12, 2004, convicting defendant upon his plea of guilty of the crime of grand larceny in the third degree.
Defendant waived indictment and consented to be prosecuted by a superior court information charging him with grand larceny in the third degree, two counts of unauthorized use of a motor vehicle in the second degree and criminal mischief in the fourth degree.
