MEMORANDUM OPINION AND ORDER

LAMBROS, District Judge.

There are a number of motions pending, filed on behalf of both the plaintiff and the defendants. This opinion will concern itself with these matters.

I. FACTUAL BACKGROUND

This action was commenced in an Ohio state court and alleged a contract breach and violation of Ohio’s anti-trust laws. Plaintiff Akron Tire Supply (“ATS”) was suing two German corporations, Gebr. Hofmann KG (“Hofmann-Darmstadt”) and Dionys Hofmann Gmbh (“Dionys Hofmann”), as well as Hofmann Corporation, a New Jersey corporation, and FMC Corporation, a Delaware corporation.…
