In an action, inter alia, to rescind a Sheriff's deed, the plaintiff appeals from so much of an order of the Supreme Court, Suffolk County (Saladino, J.), dated June 5, 1987, as, upon the motion of the defendant Berlin, dismissed the first, second, third, fourth, fifth, sixth, seventh, eighth, fourteenth and fifteenth causes of action asserted in the complaint as against the defendant Berlin, without prejudice.

Ordered that the order is affirmed insofar as appealed from, with costs.
