The question as to the right of the complainant to enforce a conveyance of tkjs \m(¡j which is the subject of controversy, is so plain from the pleadings and proofs before me, that j not ta^e time to write an opinion upon that point, but shall proceed at once to the other point, . presented by the counsel, and argued by them as the principal point, which is both a question of costs and of jurisdiction.
