The Atlanta Joint Stock Land Bank brought suit against Hubert Watson, alleging that the defendant is indebted to the plaintiff on a note which is attached to and made a part of the petition; that ten days before filing suit the defendant was served with notice of the intention to bring suit and to claim attorney’s fees (the note calling for ten per cent, attorney’s fees); and that defendant fails and refuses to pay the indebtedness.
