Appellant was the owner and proprietor of a number of stores, including one located at South Bend, all of which were under the supervision of appellant’s New York office. Appellee brought this action to recover compensation for his services as manager of the South Bend store, from April 1, 1909, to February 7, 1911. The first, second and fourth paragraphs of complaint declare on a written contract. The third paragraph is based on the quantum meruit.
