BASTIAN, Circuit Judge.

This appeal by the United States is from a final order of the District Court granting appellee’s (defendant’s) motion to dismiss an indictment on the ground of double jeopardy.

On August 18, 1958, appellee, 17 years of age, was arrested pursuant to petitions filed in the Juvenile Court under the provisions of § 11-908, D.C.Code (1951). These petitions charged robbery on August 15, 1958, and conspiracy to commit robbery on August 19, 1958.
