The plaintiff in error, hereinafter called defendant, was convicted in the district court of Tulsa county of murder, and was sentenced to life imprisonment.

The record discloses that, at the time charged, defendant, as a result of some quarrel over the use of a garage, shot and killed Charles Morton. Morton at the time was in an automobile attempting to enter the garage, and defendant was on the running board. In this altercation defendant himself was twice shot by the pistol in his own hands.
