Fannie Bowe sued the Metropolitan Life Insurance Company on a life-insurance policy issued by the defendant on the life of Pricilla Head, in which plaintiff was named as beneficiary. The jury found for the plaintiff and the defendant excepted to the overruling of its motion for new trial.
The policy contained the following provision: “This policy shall' be incontestable after it has been in force during the lifetime of the insured for a period of one year from its date of issue, except for non-payment of premiums.
