Appeal by the defendant from a judgment of the County Court, Nassau County (Baker, J.), rendered July 13, 1988, convicting him of criminal possession of a forged instrument in the second degree, upon a jury verdict, and sentencing him to an indeterminate term of 116 to 3 years’ imprisonment, and imposing a fine of $10,000.
Ordered that the judgment is modified by reducing the fine to $5,000; as so modified, the judgment is affirmed, and the matter is remitted to the County Court, Nassau County, for further proceedings pursuant to CPL 460.50 (5).
