We granted Herman Elder’s motion for interlocutory appeal of the trial court’s order denying his motion for summary judgment in this action arising out of a fatal automobile collision. The wreck occurred when Wendell Hardigree’s truck rear-ended Tiffany Hayes’s sedan, causing it to spin and hit Elder’s SUV. Hayes and two other occupants of her car (collectively referred to herein as the “Plaintiffs”) sued Elder for negligence, and Elder argued in his motion for summary judgment that there was no evidence that his negligence, if any, proximately caused the Plaintiffs’…
