HEHBY, Associate Justice.
—This was an action of trespass to try title, brought by the appellant against the appellee, to recover lots 8, 9, and 10, in block No. 29, of the Houston & Texas Central Railroad addition to the city of Corsicana. The defendant pleaded not guilty.
It was agreed that the Houston & Texas Central Railroad Company was the common source of title.
Plaintiff introduced the following evidence:
A deed from the railroad company to James Garrity for the land in controversy, dated in the year 1879.
