On March 16, 1916, defendant issued to plaintiff a policy of indemnity insurance limited to the sum of $5,000 against loss or expense arising or resulting from claims upon the assured for damages on account of bodily injuries or death suffered by any person or persons other than employees of the assured, in consequence of any and every accident.
