The following facts, as alleged in the plaintiff’s petition herein are not disputed:

On June 22, 1939, Thomas O. Woods entered into a contract with Louis A. Spedale for the erection and construction of a one-story frame dwelling on a lot of ground belonging to Woods and situated in a suburb of the City of Baton Rouge known as University Gardens. The contract price was $3,600, the contractor agreeing to furnish all labor and material necessary to complete the job on or before August 26, 1939.
