Appellant was convicted of murder in the second degree, on an indictment charging murder in the first degree, for the killing of it. O. Lawhorn,-and sentenced to ten years in the penitentiary.

• The first assignment of error urged for a' reversal of the case relates to the refusal of the court to permit the witness, Dr. C. M. Bouth to answer a question as to about how long, in his opinion, he thought appellant would live.
