BACKGROUND

The background of this case has been set forth previously in this court’s order of September 11, 1989. Item 21. At that time, the court denied defendants’ motions to dismiss and permitted discovery to proceed. Discovery is now complete. Plaintiff has stipulated to the withdrawal of its claims against all defendants except the County of Chautauqua. Items 29, 33, 37.
