NORTHCUTT, Justice.

This is an appeal from a judgment of the District Court granting appellee a summary judgment that the plaintiff take nothing by its suit; that defendant’s plea of abatement be granted and that plaintiff take nothing and the case in all things dismissed. Just why a summary judgment was entered and then sustaining defendant’s plea of abatement and dismissing the case, we do not understand.
