This matter comes before us upon the motion of the district attorney to dismiss the case. That motion must be determined from the record. On Aug. 17, 1927, the defendant presented his petition, averring that upon the information of sergeant of police of the Borough of Steelton he was charged before the chief burgess with, disorderly conduct, in violation of a borough ordinance, and sentenced to pay a fine of $10 and the costs of prosecution; that he was not guilty of such offense, and asked for an appeal from said judgment.
