By this interlocutory appeal, the University of Texas Health Science Center at Houston (UTHSCH) challenges the trial court’s denial of UTHSCH’s motion to dismiss Bryan Joplin and Janice Joplin’s law*775suit with prejudice for failure to serve an expert report and curriculum vitae (CV) pursuant to section 74.351 of the Texas Civil Practice and Remedies Code.
