Rich, J.:

The defendant is the successor to the liabilities of the Washington Marine Insurance Company, which issued to plaintiffs, on February 20, 1920, five marine certificates of insurance, under its open policy No. 1120, for $12,000, covering 1,000 barrels of potatoes, per steamship Corsicana, from New York to Caibarien, Cuba. The defendant agreed to insure against “ perils of the seas, fires, pirates, rovers, assailing thieves, jettisons, criminal barratry of the master and mariners, and all other like perils, losses and misfortunes that have or shall come to the hurt, detriment or damage…
