Appeal by Nathan Hinckley, as executor, etc., of Thomas Loft-Louse, deceased, from an order of the Supreme Court, made at the Monroe Special Term and entered in the office of the clerk of the county of Wayne on the 31st day of January, 1895, adjusting certain bills of costs and expenses in a proceeding for the appointment of a committee of Thomas Lofthouse, an alleged lunatic.

Ward, J.:

On April 20, 1894, the petition of George Lofthouse was presented, by his attorneys, to the Special Term of the Supreme Court praying for a commission Ixmatico de inquirendo to inquire into the lunacy of his father, Thomas Lofthouse. The court at Special Term appointed C. H. Ray as special guardian for the said Thomas Lofthouse to attend to his interest in the proceeding under a commission, which was granted, and appointed E. W.
