I. On January 10, 1910, the parties 'to this action entered into a written contract, by the terms of which appellant agreed to sell and convey to appellee, for a consideration of $3,700, two lots and the buildings thereon, in the town of Kiron, Crawford County, Iowa, subject to a mortgage .thereqn of $800. Appellee agreed to sell and convey to appellant a quarter section of land in Dickey County, North Dakota, for a consideration of $3,700.
