On the 8th day of November, -1895, the parties to this action entered into a contract of sale, in and by which *471the defendant agreed to sell and the plaintiff to purchase certain, real estate situate in the city of New York for the sum of $65,000, and the plaintiff then paid to apply on the purchase price the sum of $2,000. On the 13th of January following, the time fixed for the completion of the contract, the defendant tendered to the plaintiff a deed, proper in form, and the plaintiff was ready and willing to pay the balance of the purchase money, but he objected to the defendant’s title,…
