—The plaintiff in error was convicted in the Circuit Court for Manatee County of an “assault to commit murder in the second degree” and sentenced to im*525prisonment in the penitentiary for a period of five years. The indictment charged that the assault was made upon E. B. Stevens with a premeditated design to- effect his death and that the weapon used was a shot gun.
