The action is at common law, for negligence.
The plaintiff was employed as an electrician by the defendant, upon work in the northbound tube of the McAdoo tunnel or subway of the Hudson and Manhattan Railroad Company, running from the Erie railroad station in Jersey City to the Lackawanna railroad station in Hoboken, H. J. At the time of the accident which gave rise to this action he had been so employed for about two months.
