This is an action brought by defendant in error, as plaintiff, against plaintiff in error, A. J. Hughes, doing business as the A. J. Hughes Grain Company, to recover the value of 265 bushels of wheat alleged to have been converted by said A. J. Hughes, doing business as the A. J. Hughes Grain Company. The parties will be referred to as in the trial court.

Plaintiff was a farmer near Tyrone, in Texas county. Defendant operated a grain elevator in Tyrone, Okla., and was engaged in buying wheat and other grain.
